Biker avoids ban after officer records speed in excess of 120mph on the M1
Mark Troman was instructed to appear on behalf of the defendant who risked immediate disqualification due to the excessive speed recorded by a patrol car. Our client’s circumstances were familiar to many: he was married with children where both parents worked full-time and commuted long distances; he simply could not afford to lose his licence. A disqualification is the norm in these circumstances however we were able to persuade the court to make an exception and impose 6 penalty points instead.
Pensioner spared disqualification after failing to provide breath sample
We recently represented a pensioner who, after being treated poorly by the Metropolitan police, refused to provide a sample of breath to police and faced a disqualification from driving for between 17 and 28 months. Despite her disabilities she lived independently but her licence was crucial to this. We were able to persuade an experienced district judge not to enforce the ‘mandatory’ disqualification but to find exceptional circumstances. She left court with her licence and without having to pay a fine or prosecution costs. This client came to us shortly before the date of trial having been dissatisfied with the services of another firm of solicitors who could not provide her the specialist advice that road traffic matters require.
Local Taxi driver acquitted of causing death by dangerous driving
Whenever a person dies in a road traffic collision there is a great sense of sadness and loss for the friends and family left behind. The police, unsurprisingly, will go to considerable lengths to investigate the cause of the crash and investigate who is to blame. That is what happened recently following one such tragedy on the Paddington flyover, leading to the prosecution of one of our clients for causing death by dangerous driving. The charge was laid on the basis of a number of factual assertions, many of which were based upon technical evidence. Mark Troman, in representing this defendant, assisted him in responding to the allegations and understanding what must have been an intimidating judicial process.
